    Merner's Painting & Decorating (“Company,” “we,” “us,” or “our”) operates mernerspainting.ca and related online services (collectively, the “Site”). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit the Site, submit a quote or contact request, communicate with us by phone, email, or text message, or otherwise interact with our painting and decorating services in Canada.

    This Policy is intended for individuals located in Canada. Our services are offered to customers in Winnipeg, Manitoba and surrounding communities.

    By using the Site or providing personal information to us, you acknowledge that you have read this Privacy Policy. Where required by law, we will obtain your consent before collecting or using personal information for certain purposes.

    1. Who We Are

    Merner's Painting & Decorating is a painting and decorating business serving Winnipeg, MB and surrounding areas. For privacy-related requests, contact us using the information in Section 15 below.

    Information we do not knowingly collect

    • We do not knowingly collect personal information from children under 13 (see Section 10)
    • We do not intentionally collect social insurance numbers, driver’s licence numbers, or government ID numbers through the Site
    • We do not require you to create an account to request a quote

    • Service providers that help us operate the Site, deliver messages, or process payments

    3. How We Use Personal Information

    • Respond to quote requests and provide estimates, scheduling, and contracting services
    • Communicate with you about your project, appointments, job status, and customer support
    • Send service-related SMS or email messages you have consented to receive
    • Process payments and maintain business records

    We do not sell your personal information. We do not sell or rent personal information to data brokers or third parties for their independent marketing purposes.

    We do not share personal information for cross-context behavioural advertising as defined under applicable Canadian privacy laws.

    We may disclose personal information to the following categories of recipients:

    • Service providers and contractors who perform services on our behalf (hosting, form processing, SMS delivery, email, analytics, payment processing, CRM, scheduling, and IT support), subject to contractual obligations to protect the information and use it only for our purposes
    • Professional advisors such as attorneys, accountants, or insurers when reasonably necessary
    • Business transfers in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to the transferee honoring this Policy
    • Legal and safety disclosures when we believe disclosure is required by law, to respond to lawful requests, to protect rights and safety, or to investigate fraud or security issues

    SMS and mobile information: strict non-sharing

    No mobile information, SMS opt-in data, or text messaging consent will be shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties except with SMS aggregators and delivery providers solely to transmit messages you have agreed to receive, or as otherwise required by law.

    5. SMS Messaging, CASL & Telemarketing Compliance

    If you opt in to receive text messages from us, you agree to receive SMS related to quotes, appointments, customer support, and service updates. Message frequency varies. Message and data rates may apply.

    • Opt-in is collected through affirmative action (for example, checking a consent box or submitting a form after viewing SMS terms)
    • We maintain timestamped records of opt-in and opt-out actions
    • Reply STOP at any time to cancel. Reply HELP for help
    • We comply with Canada’s Anti-Spam Legislation (CASL), applicable CRTC rules for telemarketing, and PIPEDA
    • Carriers are not liable for delayed or undelivered messages
    • You must be 18 or older to opt in to our SMS program

    6. Cookies & Tracking Technologies

    We and our service providers may use cookies, local storage, pixels, and similar technologies to operate the Site, remember preferences, measure traffic, and understand how visitors use our pages.

    You can control cookies through your browser settings. Disabling cookies may affect Site functionality.

    We do not respond to browser “Do Not Track” signals because there is no uniform industry standard. Where required by law, we honor applicable opt-out preference signals.

    7. Data Retention

    We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide services, maintain business records, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods vary based on the type of information and why we collected it. When information is no longer needed, we delete, anonymize, or securely dispose of it in accordance with our retention practices.

    We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or destruction.     No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for safeguarding any credentials or devices you use to communicate with us.

    If we become aware of a data breach involving personal information that triggers notification obligations under applicable Canadian law, we will notify affected individuals and regulators as required.

    9. Children’s Privacy

    The Site is not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately and we will take steps to delete it.

    10. Your Privacy Rights (PIPEDA)

    Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Manitoba law, you may have the right to access, correct, and withdraw consent for the use of your personal information, subject to exceptions. We will not refuse you a service or penalize you solely for exercising these rights, except as permitted by law.

    How to submit a privacy request

    11. Marketing Communications

    You may opt out of promotional emails by clicking “unsubscribe” in any marketing email or by contacting us. You may opt out of SMS by replying STOP. Opting out of marketing does not affect service-related messages necessary to fulfill a request or active job.

    12. Third-Party Links & Services

    The Site may link to third-party websites or services (for example, financing partners, social media, or maps). We are not responsible for the privacy practices of those third parties. Review their policies before providing personal information.

    13. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes will be posted on this page. Where required by law, we will provide additional notice. Continued use of the Site after changes become effective constitutes acceptance of the updated Policy, to the extent permitted by law.

    14. Governing Law & Disputes

    This Privacy Policy is governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute relating to this Policy or our handling of personal information shall be brought in the courts located in Winnipeg, Manitoba, unless otherwise required by applicable privacy law.

    Nothing in this Policy limits any non-waivable consumer rights you may have under Canadian federal or provincial law.
